These Terms and Conditions („Terms„) govern your access to and use of the website temporaryfame.com (the „Website„, the „Service„), operated by:

By submitting an entry, creating a submission, or otherwise using the Website, you („you„, „User„, „Participant„) agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. Description of the Service

Temporary Fame is a conceptual, entertainment-oriented web project. Each day, one submitted entry (an image and an accompanying message) is randomly selected and displayed as the sole featured entry on the homepage for a period of approximately 24 hours („Feature Window„), after which it is permanently replaced by the next selected entry.

The Service is provided as a creative/artistic project. It is not a competition with guaranteed prizes, a lottery, a game of chance within the meaning of German gambling law (Glücksspielstaatsvertrag), or a service that guarantees any particular outcome, reach, or result to Participants. Selection, timing, and duration of any Feature Window are at the Operator’s sole discretion and may be changed, paused, or discontinued at any time as described in Section 10.

2. Eligibility

The Service is intended for individuals aged 16 and above. By submitting content, you confirm that you are at least 16 years old, or that you have the consent of a parent or legal guardian. We do not knowingly collect content from individuals under this age and will remove such content upon becoming aware of it.

3. Submissions and License Grant

3.1. By submitting an image, message, or any other content („Submission„) through the Website, you grant the Operator a non-exclusive, worldwide, royalty-free, sublicensable license to store, reproduce, display, and publicly communicate your Submission on the Website and in connection with promoting the Website (e.g., social media previews, archival display) for as long as reasonably necessary to operate and promote the Service.

3.2. This license does not transfer ownership of your Submission. You retain all rights you hold in your content, subject to the license granted above.

3.3. You may request removal of your Submission at any time before it is featured. Once a Submission has been displayed during its Feature Window, removal from public display going forward can still be requested, but we cannot undo the fact that it was previously publicly visible.

4. Your Representations and Warranties

By submitting content, you represent and warrant that:

  • You own or have all necessary rights, licenses, and consents to submit the content and to grant the license in Section 3;
  • The content does not infringe any third party’s intellectual property, privacy, or personality rights;
  • The content does not depict any identifiable third person without that person’s consent;
  • The content is not unlawful, defamatory, obscene, hateful, discriminatory, violent, sexually explicit involving minors, or otherwise in breach of applicable law (including German criminal law, §§ 86, 130, 131, 184 StGB and equivalent provisions);
  • The content does not contain malware, spam, or unsolicited advertising;
  • You are not submitting on behalf of, or impersonating, another person without authorization.

5. Content Moderation and Selection

5.1. All Submissions undergo a review/confirmation process (including double opt-in email confirmation of the Submission’s email address) before being eligible for selection.

5.2. We reserve the right, at our sole discretion and without obligation to provide reasons, to reject, remove, or decline to feature any Submission at any stage, including after confirmation and before or during a Feature Window.

5.3. There is no guaranteed timeframe within which a confirmed Submission will be selected, and submission does not guarantee selection.

6. Prohibited Conduct

You agree not to:

  • Submit multiple entries using false, disposable, or another person’s email address in order to circumvent the double opt-in / anti-spam mechanism;
  • Use automated means (bots, scripts) to submit entries or interact with the Website;
  • Attempt to manipulate, exploit, or interfere with the selection mechanism, timers, or cron-based scheduling of the Service;
  • Attempt to gain unauthorized access to the Website, its underlying systems, or other users‘ data;
  • Use the Website for any unlawful purpose.

Violation of this Section may result in immediate removal of your Submission and exclusion from future participation.

7. Intellectual Property

Except for User Submissions, all content, design, source code, branding, and materials on the Website are owned by the Operator or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use the Operator’s trademarks, logos, or branding without prior written consent.

8. Paid Features

The Service is currently offered free of charge. Should the Operator introduce paid features in the future (e.g., paid entry slots, auctions, or similar monetized mechanics), such features will be governed by supplementary terms published at that time, which will include all consumer-protection information required under German and EU law (including statutory withdrawal rights under §§ 355, 356 BGB, pricing, and payment terms). These Terms do not currently authorize or describe any payment obligation.

9. Disclaimer of Warranties

The Service is provided „as is“ and „as available,“ without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. We do not warrant that the Website will be uninterrupted, error-free, secure, or available at all times (in particular given that scheduled/cron-based processes depend on third-party infrastructure).

10. Availability, Changes, and Termination

We may modify, suspend, or discontinue the Website or any part of the Service at any time, including the selection mechanism, Feature Window duration, or availability of the Website, without liability to you, except as required by mandatory law.

11. Limitation of Liability

11.1. To the extent permitted by law, the Operator’s liability is limited as follows: the Operator is liable without limitation for damages resulting from injury to life, body, or health, for intent and gross negligence, and under the German Product Liability Act (Produkthaftungsgesetz) and other mandatory statutory liability.

11.2. For damages caused by slight (ordinary) negligence, the Operator is liable only in the event of a breach of a material contractual obligation (a „cardinal obligation“ — an obligation whose fulfillment is essential to the proper performance of the contract and on whose compliance you may regularly rely), and in that case liability is limited to the foreseeable, typically occurring damage.

11.3. The above limitations apply equally in favor of the Operator’s legal representatives and vicarious agents.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold the Operator harmless from third-party claims arising out of your Submission or your breach of these Terms, except where such claims result from the Operator’s own breach of duty.

13. Governing Law and Jurisdiction

13.1. These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

13.2. If you are a consumer habitually resident in another EU/EEA member state, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence, in accordance with Article 6 of Regulation (EC) No 593/2008 („Rome I“).

13.3. For Users who are merchants (Kaufleute), legal entities under public law, or special funds under public law, the exclusive place of jurisdiction for all disputes arising from these Terms is Leipzig, Germany. For consumers, statutory rules on jurisdiction apply and are not restricted by this clause.

14. Alternative Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), available at https://ec.europa.eu/consumers/odr/. We are not obliged and, at present, not willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) pursuant to the German Consumer Dispute Resolution Act (VSBG).

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be deemed replaced by a valid provision that most closely reflects the economic intent of the original.

16. Changes to These Terms

We may update these Terms from time to time. The version published on the Website at the time of your use applies. Material changes will be indicated by an updated „Last updated“ date.
